Terms of Service

Plain English summary: By using DATSpeed you agree to these terms. The service costs $7.00/month or $70.00/year after a 7-day free trial. You can cancel at any time. We don't guarantee uptime and aren't liable if DAT One changes their interface. Don't use DATSpeed for anything illegal or to abuse third-party services.

1. Acceptance of Terms

By installing, accessing, or using the DATSpeed Chrome extension or this website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not install or use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and DATSpeed ("DATSpeed," "we," "us," or "our"). DATSpeed is not affiliated with DAT Freight & Analytics, RTS Financial, Apex Capital Corp, or Google LLC.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use DATSpeed. By using the Service, you represent that you meet these requirements. The Service is intended for professional use by freight dispatchers and owner-operators with a legitimate DAT One subscription.

3. The Service

DATSpeed is a Chrome browser extension that injects supplemental functionality into the DAT One load board interface (one.dat.com). Features include keyboard navigation, Gmail integration, Google Maps integration, smart load filters, an embedded route map, and RTS Pro credit rating display.

DATSpeed operates by interacting with third-party services (DAT One, Google Gmail, Google Maps, RTS Pro, OpenStreetMap, and OSRM). We make no guarantee that these integrations will remain functional if those third-party services change their interfaces, APIs, or terms of use. In such cases, affected features may be temporarily or permanently unavailable.

4. Free Trial & Subscription

New users receive a 7-day free trial beginning on the date of installation. No payment information is required to start the trial.

After the trial period ends, continued access to DATSpeed requires an active paid subscription at $7.00 USD per month or $70.00 USD per year. Subscriptions are billed on a recurring basis until cancelled.

We reserve the right to change subscription pricing with at least 30 days' advance notice. Price changes will not apply to your current billing cycle.

5. Cancellation & Refunds

You may cancel your subscription at any time from your account dashboard. Upon cancellation:

You will retain full access to DATSpeed until the end of the current billing period you have already paid for.
You will not be charged again after cancellation.
No partial refunds are issued for unused days within a billing period.

When switching from an Annual plan to a Monthly plan, the unused portion of your annual subscription is applied as a credit toward future monthly charges. Cash refunds for unused annual subscription time are handled on a case-by-case basis — contact support@datspeed.app to request one.

If you believe you were charged in error, contact us at support@datspeed.app within 30 days and we will review your case.

6. Acceptable Use

You agree to use DATSpeed only for its intended purpose of enhancing your personal freight dispatching workflow. You agree not to:

Share, resell, sublicense, or distribute your DATSpeed subscription to other users.
Use DATSpeed to send spam, unsolicited commercial messages, or abusive emails to brokers or any third party.
Attempt to reverse-engineer, decompile, or modify the DATSpeed extension.
Use DATSpeed to scrape, harvest, or bulk-collect data from DAT One, RTS Pro, or any third-party service in violation of those services' terms of use.
Use DATSpeed in any way that violates applicable local, state, federal, or international law.
Circumvent, disable, or interfere with security features of the Service or any related service.
Create multiple accounts or use alternate email addresses to circumvent the 7-day free trial limit. Each user is entitled to one free trial. Attempts to bypass this limit by registering additional accounts will result in immediate revocation of all associated accounts without notice.

We reserve the right to suspend or terminate your account immediately and without refund if you violate these acceptable use provisions.

7. Third-Party Services

DATSpeed integrates with the following third-party services. Your use of those services is governed by their respective terms and policies — not ours:

DAT One — you must maintain a valid DAT One subscription to use DATSpeed.
Google Gmail — the Gmail send feature requires a Google account and your authorization via Google OAuth.
RTS Pro — the credit rating feature requires an active RTS Pro account.
Apex Capital — the Apex factoring credit feature requires an active Apex Capital account and the AMP portal open in your browser. DATSpeed is not affiliated with Apex Capital Corp. Your use of Apex Capital's services is governed by Apex Capital's own terms of service.
OpenStreetMap & OSRM — map and routing data is sourced from these open-source providers.

We are not responsible for the availability, accuracy, or performance of any third-party service.

8. Intellectual Property

DATSpeed and its original content, design, code, and trademarks are owned by DATSpeed and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the extension for personal, professional dispatching purposes during an active subscription period.

You do not acquire any ownership rights by using DATSpeed. Cancelling your subscription or violating these Terms immediately terminates your license.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that any particular feature will remain available. DAT One, RTS Pro, Gmail, and other third-party platforms may change their interfaces at any time, which may cause DATSpeed features to stop functioning.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DATSPEED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, MISSED LOADS, BUSINESS INTERRUPTION, OR LOSS OF DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability to you for any claims arising under these Terms shall not exceed the total amount you paid to DATSpeed in the 30 days preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless DATSpeed and its operators from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your violation of these Terms, your misuse of the Service, or your violation of any third party's rights.

12. Modifications to the Service or Terms

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms. Material changes will be communicated via the extension popup or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration rather than in court, except where prohibited by law.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
